Release of liability after selling a car
The Notice of Transfer and Release of Liability tells the DMV you no longer own the car. It protects you if the buyer gets tickets or worse.
The deadline
File within 5 calendar days of the day you hand over the car (California Vehicle Code section 5900).
How to file
- Online on the DMV's release of liability page. Save the confirmation as proof. The DMV updates its record within one business day.
- By mail on form REG 138. Keep a photocopy before you mail it.
What you need
- Buyer's name and address
- License plate number
- Last five digits of the VIN
- Odometer reading and date of sale
- Your name and address
Why it matters
Once the DMV has a valid notice, responsibility for parking, traffic and civil matters after the sale date moves to the buyer. Your name stays on the record until the buyer finishes the transfer, so keep your confirmation.
